General terms and conditions

I. Scope of application

(1) The terms and conditions below constitute the conditions under which natural and legal persons (USERS) enter into a business relationship with Salzburger Biermanufaktur GmbH (DIE WEISSE) through the website at www.dieweisse-shop.at.

(2) A deviation from the terms and conditions is not be accepted unless DIE WEISSE expressly agrees in writing.

(3) The offers at www.dieweisse-shop.at are exclusively aimed at persons who are domiciled or permanently resident in Austria and Germany.

II. Services

(1) The use of the online portal at www.dieweisse.at is free.

(2) DIE WEISSE makes the online portal at www.dieweisse-shop.at available to users for the purposes of accessing information about the products offered there, to purchase the products, and to review and to comment on them.

III. Sales

(1) DIE WEISSE presents the goods produced by them to users, makes available the ordering and payment process and organises the dispatch of the products.

(2) The product images that are used to describe the products are sample photos and are not always a lifelike image of the items, but rather only serve to present them. Colours and sizes may vary for technical reasons. What is relevant is the detailed description of the respective item.

IV. Contract conclusion

(1) The orders placed at www.dieweisse-shop.at constitute an offer to DIE WEISSE for the conclusion of a purchase agreement. When a user places an order at www.dieweisse-shop.at, he will receive a confirmation email that confirms the receipt of the order by DIE WEISSE and lists the details of the order (order confirmation). The order confirmation does not constitute acceptance of the offer; rather it is designed to inform the user that DIE WEISSE has received the order. A purchase agreement is concluded once the ordered product is dispatched to the user and the dispatch was confirmed by a second confirmation email (dispatch confirmation). No purchase agreement is entered into regarding products that are part of the same order but that are not listed in the dispatch confirmation email.

(2) DIE WEISSE does not offer products that can be purchased by minors.

(3) The contract is concluded with: Salzburger Biermanufaktur GmbH.

(4) The terms for the purchase of the products on offer are based solely on the general terms of business that are valid at the time of ordering.

(5) All quantities are available to a limited extent and availability may be limited. Orders are accepted subject to availability. If a product has been ordered excessively DIE WEISSE reserves the right to allocate lower quantities to the persons who placed the order. If the delivery or compliance with the agreed delivery deadline becomes impossible for reasons that DIE WEISSE is not responsible for, then the obligation to deliver at the agreed delivery deadline is void. Reasons that DIE WEISSE is not responsible for in particular include: Difficulties in obtaining goods or primary materials from third parties, in the case of subscriptions the late release of the goods by the supplier of DIE WEISSE, operational disruptions (including on supplier side), traffic disruptions, lockouts and strikes as well as cases of force majeure. In such events, DIE WEISSE will contact the buyer immediately in order to agree on an alternative delivery date. If DIE WEISSE offers the buyer a new delivery date that is no later than two weeks after one of the originally agreed delivery dates, and if the delivery is properly carried out on that new date, then the delivery is deemed to have been made in time by DIE WEISSE within the meaning of the purchase agreement.

(6) If DIE WEISSE is not able to offer the buyer a new delivery date in accordance with section 6.3 or if the new delivery date as per the cases mentioned in section V.

(7) (delivery not possible for reasons DIE WEISSE is not responsible for) cannot be met, DIE WEISSE has the right to withdraw from the contract in full or in part without becoming liable to pay damages. Similarly, the buyer is also entitled to withdraw from the contract in such cases.

(8) In the case of partial deliveries, the buyer does not have the right to withdraw with regard to the deliverable parts, insofar as parts of the performance are executable and usable for the buyer. Under the same conditions, or if the remaining parts (within the meaning of section V.) can be delivered later, then the buyer does not have the right to refuse the acceptance of partial deliveries.

V. Cancellation

Users may cancel their order within 14 days without providing any reasons, in text form as a letter or by returning the goods. This period starts on the day the delivery is received by the user. To comply with the cancellation period it is sufficient to send the cancellation notice on time. The cancellation notice must be sent to: DIE WEISSE, Bayerhamerstrasse 10, 5020 Salzburg, Austria.

In the event of a valid cancellation, the received deliveries must be returned and any benefits (e.g. interest) released. If the user can only return the received goods in depreciated condition, he must pay us compensation. The user can avoid having to pay compensation if he does not use the goods as his property and refrains from doing anything that compromises their value. Goods that can be sent as a package must be sent back sealed. The costs for the return are borne by the user. These goods may not be returned: goods that are produced according to customer specifications or are clearly tailored to personal needs or goods which by their nature are not suitable for sending back or that spoil quickly or if the use-by date would be exceeded if returned.

VI. Prices and shipping costs

(1) The prices specified at the time of the order apply. The prices mentioned on the product pages include the statutory VAT according to Austrian regulations as well as other price components. Price changes and errors excepted.

(2) In addition to the purchase price, the user also pays for the shipping costs. The shipping costs depend on the weight of the ordered goods and the shipping method, and they are clearly stated before the binding order is placed within the ordering process.

(3) The prices stated on the website or in the price lists (etc.) – unless explicitly stated otherwise in individual cases – are always non-binding. The same applies to follow-up orders.

VII. Delivery

(1)The goods are only delivered to the countries listed below,

Austria, Germany

and to the delivery address specified in the order. The delivery time to Austria and Germany is usually 3 to 5 business days from the date of shipment. The delivery time within the European Union is usually 5 to 10 business days from the date of shipment. It should be noted that all information provided regarding availability, shipment or delivery of a product is merely estimated, non-binding information and approximate.

(2) The user is responsible for the acceptance of the products. If the user is unavailable at the time of delivery or if an alternative delivery is not possible, he bears the sole risk for the goods spoiling or being sent back. No refund is given for goods that have spoiled for this reason.

VIII. Payment

(1) The user may complete the ordering process at www.dieweisse-shop.at only once he has provided electronic payment (advance payment). DIE WEISSE only accepts payment for the goods in advance or as cash on delivery. In the case of cash on delivery, an additional fee of 5.90 euros will be charged.

(2) If the purchase price is transferred without payment services, the goods are dispatched once the money has gone into the account of DIE WEISSE (Salzburger Biermanufaktur GmbH, IBAN: AT83 3500 0000 9401 2770, BIC: RVSAAT2S).

IX. Set-off, retention

(1) The orderer has a right of set-off only if his counterclaims have been legally established and are undisputed by DIE WEISSE. Furthermore, he has the right to exercise a right of retention only insofar as his counterclaim is based on the same contractual relationship.

X. Prices

(1) All prices include the applicable statutory value added tax.

XI. Reservation of title

(1) The delivered goods remain the property of DIE WEISSE until full payment has been made.

XII. Defects

DIE WEISSE must be notified of any defects immediately. If the user does not do this, claims for compensation are excluded.

XIII. Liability

(1) DIE WEISSE undertakes the presentation, the order and payment processing and the organisation of the shipment of those products that are offered by the individual breweries at www.dieweisse-shop.at.

(2) DIE WEISSE organises the shipping. Damages that occur during transport are attributable to the dispatch or delivery company. The user is responsible for complaining to the delivery service about transport damage when accepting the packages.

XIV. Registration

(1) The user has to register/login in order to use the online shop of DIE WEISSE. A user may only register in his own name and only natural persons of legal age and legal persons may register. Registration is free of charge and is carried out by completing the online registration form at www.dieweisse-shop.at.

(2) The data requested during registration must be provided in full and correctly. The user is responsible for the completeness and accuracy of this information

(3) Once the user has completed the application form and submitted it, he can shop at www.dieweisse-shop.at.

(4) To terminate his registration and delete his profile, the user must send an email to DIE WEISSE.

(5) By registering, the user agrees to his data to be stored in the system.

(6) The data are not passed on and remain solely in the possession of DIE WEISSE.

XV. The obligations of the user

(1) The user must ensure that his access data (username and password) are accessible to any third party. In particular, the user may not pass on his access data to third parties. For his own protection and internet security, the user should change his password at regular intervals.

(2) The user shall immediately declare it if the data he provided change, especially insofar as these are necessary to process any open orders.

XVI. Blocking the user

(1) DIE WEISSE has the right to block a user if there is a valid reason. The user can be blocked without prior notice if DIE WEISSE has a legitimate interest in immediately blocking him. A reason for the blocking exists in particular if the user violates his obligations under this agreement or if third parties assert an infringement to DIE WEISSE. In the event of such an infringement claim DIE WEISSE will pass on the relevant information to the user. DIE WEISSE is not required to verify the allegations.

XVII. Data privacy (data collection, use of data, storage duration, customer account)

The protection of your data is very important to us. Since we do not disguise the content of our beers, we also show you in detail what happens to your data.

You can visit our website without entering data. We only store access data in order to analyse them and to improve our services. The stored data are not associated with your person. We store your data only if you make them available to open a customer account or to subscribe to a newsletter. This information will be used to fulfil the contract or for advertising. Personal data are used in compliance with Austrian law (§96 TKG and § 8 DSG).

XVIII. Rights of the user

(1) The user has the right to receive information about which of his personal data are stored. The corresponding request is to be sent to prost@salzburgerweissbier.at

(2) If the stored data have changed, the user can correct them himself via his customer account.

IX. Protection of minors

(1) Beer may only be delivered to persons over the age of 16. To comply with legal requirements DIE WEISSE is obliged to hand over the goods only once proof of identify has been provided in the form of official photo identification. In the case of a justified of handover, the customer (or his legal guardian) is liable to pay compensation for the damages incurred (e.g. delivery costs).

XX. Miscellaneous

(1) DIE WEISSE occasionally refers to third-party websites at www.dieweisse-shop.at. DIE WEISSE is not responsible or liable for the accuracy or completeness of the contents and the data security of third-party websites.

(2) DIE WEISSE therefore reserves the right to change or amend the data protection declaration as required. DIE WEISSE will publish the changes on this page. The user undertakes to familiarise himself with the current status of the data protection declaration.

XXI. Final provisions

(1) Austrian law applies exclusively. If individual provisions of this contract should be or become invalid, then this does not affect the validity of the remaining provisions.

(2) The place of jurisdiction is Salzburg.
